This User Agreement (together with TucsonBuzz’s Privacy Policy at [https://tucsonbuzz.com/privacy-policy] and DMCA/Copyright Policy at [https://tucsonbuzz.com/dmca], collectively, the “User Agreement”) governs your use of:
TucsonBuzz.com and any related mobile sites or apps (collectively, the “Site”), and
Any services, features, content, or applications offered by TucsonBuzz through the Site (together with the Site, the “Services”).
“TucsonBuzz,” “TucsonBuzz.com,” “we,” “us,” or “our” refers to the owner/operator of TucsonBuzz.com.
Please read this User Agreement carefully. It contains important terms that affect your legal rights, including a class action waiver.
1. Acceptance of This User Agreement
By accessing, visiting, registering for, or using the Services in any way, you:
Confirm that you have read, understood, and agree to be bound by this User Agreement; and
Agree to any additional terms or policies we may post on the Site from time to time (collectively, “Additional Terms”). Any Additional Terms are incorporated into this User Agreement by reference.
If you do not agree to this User Agreement, you may not use the Services.
We may update or modify this User Agreement at any time in our discretion by posting an updated version on the Site. Your continued use of the Services after any changes become effective means you accept the updated terms.
2. Arizona-Only Eligibility
TucsonBuzz is a local community platform focused on Tucson, Arizona.
By using the Services, you represent and warrant that all of the following are true:
You currently reside in the State of Arizona, and
You are at least 18 years of age, and
You have the legal capacity to enter into this User Agreement.
If you are under the age of consent in your jurisdiction (but at least 18), your parent or legal guardian must review and accept this User Agreement on your behalf. If you are under 18, you may not use the Services.
We may ask you to confirm your Arizona residency (for example, via your profile, IP address, or other information). We may refuse or terminate access to the Services for any user we reasonably believe does not reside in Arizona or who otherwise does not meet our eligibility criteria.
The Services are provided for personal, non-commercial use by individual users, unless we expressly authorize another type of use in writing.
3. Class Action Waiver
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.
To the fullest extent permitted by law, you agree that:
You will not bring or participate in any class action, class arbitration, or representative action against TucsonBuzz or its owners, employees, or partners.
You may only bring claims in your individual capacity, and not as a plaintiff or class member in any purported class, consolidated, or representative proceeding.
Nothing in this Section prevents you from bringing an individual action in an appropriate court.
4. Accounts & Registration
You may be able to browse some parts of the Site without creating an account. However, to use many features (such as posting stories, comments, or photos), you must register for a TucsonBuzz account (“Account”).
When creating or updating an Account, you agree to:
Provide accurate, current, and complete information, Maintain and promptly update your information, and Choose a username that is not misleading, offensive, or intended to impersonate someone else.
You are responsible for:
All activity that occurs under your Account, and Keeping your login credentials secure and confidential.
You may not:
Use another person’s Account without permission, or Share your login credentials with others.
If you believe your Account has been accessed without authorization, you must notify us promptly at [email protected].
You may request deletion of your Account by following any instructions provided in your settings or by contacting us at the email above. Some content and data may remain in our backups or records as permitted or required by law.
We may allow you to sign in using third party accounts (such as Google). By doing so, you authorize TucsonBuzz to access certain information from that third party in accordance with our Privacy Policy.
4A. Paid Subscriptions and Verified Accounts
TucsonBuzz offers an optional paid upgrade for users who want a “Verified” account (the “Verified Subscription”). Verified status is a paid feature and is not required to use the Services.
4A.1 Eligibility for Verified Accounts
To enroll in a Verified Subscription, you must:
Meet all general eligibility requirements in this User Agreement,
Reside in the State of Arizona, and
Have an active TucsonBuzz Account in good standing.
We may approve, deny, suspend, or revoke Verified status in our sole discretion.
4A.2 Subscription Fees and Billing
Verified Accounts are offered on a recurring subscription basis:
The current price for a Verified Subscription is $9.99 (USD) per month.
Prices are subject to change. If we change the monthly price, we will notify you in advance where required by law, and the new price will apply on your next billing cycle.
By enrolling in a Verified Subscription, you authorize TucsonBuzz and/or our third-party payment processors to charge your chosen payment method automatically each billing period until you cancel.
Applicable taxes and fees may be added as required by law.
4A.3 Auto-Renewal and Cancellation
Your Verified Subscription will automatically renew each month unless you cancel before the end of your current billing period.
You can cancel at any time by following the instructions provided in your Account settings or by contacting us at [[email protected]

Cancellation takes effect immediately. Your Account will revert to a standard (non-Verified) account.
4A.4 No Refunds After Use of Verified Account
Subscription fees are generally non-refundable.
In particular, and to the fullest extent permitted by law, you acknowledge and agree that:
If you have made any posts, comments, or other public activity on TucsonBuzz while your Account is marked as Verified in the current billing period, you are not eligible for a refund for that billing period.
No refunds or credits will be issued based on dissatisfaction with the amount of engagement, views, or other results your Verified Account or posts may receive.
No refunds or credits will be issued if your Verified status is suspended or revoked because you violated this User Agreement or our community rules.
Where required by applicable law, you may have certain cancellation or refund rights that cannot be waived. Nothing in this section is intended to limit those non-waivable rights.
4A.5 Nature of “Verified” Status
“Verified” on TucsonBuzz means only that:
You have completed our verification and payment process, and
You have met our eligibility criteria at the time of verification.
You may post about your service, products and deals. You may post paid events.
Verified status does not mean that:
TucsonBuzz has independently confirmed your identity beyond our verification process,
TucsonBuzz endorses, guarantees, or approves your business, services, or content, or
TucsonBuzz guarantees any level of views, traffic, or results.
You remain solely responsible for all User Content you post under your Verified Account and for complying with all applicable laws and this User Agreement.
4A.6 Suspension or Revocation of Verified Status
We may suspend or revoke your Verified status at any time, with or without notice, if we believe that:
You have violated this User Agreement,
You have misrepresented your identity, residency, or affiliation,
You are using the Verified badge in a misleading, abusive, or harmful way, or
It is necessary to protect the TucsonBuzz community or comply with law.
Except where prohibited by law, no refunds or credits will be issued if your Verified status is suspended or revoked for a violation of this User Agreement.
5. Content on the Services
5.1 Definition of “Content”
“Content” includes, without limitation:
Text, articles, posts, messages, comments, Photographs, images, graphics, videos, and audio, Software, scripts, features, and interactive elements,
Any other materials made available via the Services.
“User Content” means any Content that is created, submitted, posted, uploaded, or otherwise provided by users (including you), whether publicly or privately.
You are solely responsible for the User Content you submit. You represent and warrant that:
Your User Content is accurate, lawful, and does not violate this User Agreement or any rights of others; and
You have all rights, licenses, and permissions needed to submit the User Content and grant the licenses described below.
Accessing any Content via the Services is at your own risk. We do not guarantee that any Content will be accurate, complete, or available at all times.
5.2 Intellectual Property & TucsonBuzz Content
The Services may include Content owned by:
TucsonBuzz,
Our partners and affiliates, and/or
Other users or third parties.
Such Content may be protected by copyrights, trademarks, and other intellectual property rights. All rights not expressly granted in this User Agreement are reserved.
Without our prior written permission (or the permission of the respective rights-holder), you may not:
Reproduce, distribute, modify, or create derivative works from TucsonBuzz’s Content,
Use TucsonBuzz’s trademarks, logos, or branding, or
Use the Services or Content for any commercial purpose inconsistent with this User Agreement.
5.3 License We Grant to You
Subject to your compliance with this User Agreement, TucsonBuzz grants you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to:
Access and use the Services, and
View and display Content for your personal, non-commercial use in Arizona.
Any other use (including copying, scraping, bulk downloading, or commercial use) is prohibited unless you obtain prior written permission.
5.4 License You Grant to TucsonBuzz (User Content)
By submitting or posting any User Content via the Services, you grant TucsonBuzz a worldwide, non-exclusive, perpetual, irrevocable, royalty-free, fully paid, sublicensable, and transferable license to:
Use, host, store, reproduce, modify, adapt, edit, translate, create derivative works from,
Publish, distribute, publicly perform, publicly display, and
Otherwise exploit your User Content in connection with the operation, promotion, and improvement of TucsonBuzz and our business, in any media now known or later developed.
This includes the right to use your User Content in connection with:
TucsonBuzz’s social media, newsletters, advertising, and promotional materials; and
Sponsored content, partner content, and affiliate promotions.
To the extent your User Content includes your name, username, likeness, image, voice, or biographical information, you grant us the same license to use that information along with the User Content.
You also grant other TucsonBuzz users a non-exclusive, perpetual license to access, share, and display your User Content through the Services, consistent with this User Agreement.
Except as otherwise agreed in writing, you remain the owner of your User Content, subject to the licenses granted herein.
5.5 Waiver of “Moral Rights” (Where Allowed)
To the fullest extent permitted by applicable law, you waive any “moral rights” or similar rights (such as rights of attribution or integrity) you may have in your User Content as it relates to our use of that content in accordance with this User Agreement.
5.6 Our Control Over Content
We may, but are not obligated to:
Monitor, review, edit, or remove any Content (including User Content) at any time,
Remove or restrict Content that we believe may violate this User Agreement, the law, or the rights of others, or
Refuse to publish or display Content for any reason.
We do not promise to store or keep any Content or User Content for any period of time and may delete it at our discretion.
6. Affiliate & Sponsored Links
TucsonBuzz participates in affiliate marketing and other partner programs (for example, Amazon affiliate links). This means:
Some links on the Services may be “affiliate links.” If you click an affiliate link and make a purchase, TucsonBuzz may receive a commission or other benefit.
Any purchase you make via such links is a transaction between you and the third-party merchant, not TucsonBuzz.
We do not control or guarantee:
The content, quality, safety, pricing, or availability of third-party products or services, or
The accuracy or completeness of third-party websites.
You should review any third party’s terms and privacy policy before making purchases or sharing personal information. TucsonBuzz is not responsible or liable for any third-party websites, products, or services.
7. Rules of Conduct
To keep TucsonBuzz safe and community-focused, you agree not to:
Violate any law or third-party rights, including privacy, publicity, copyright, trademark, or contract rights.
Post unlawful or harmful content, including content that is:
Threatening, harassing, hateful, or abusive
Defamatory or invasive of privacy
Pornographic or sexually explicit
Excessively violent or otherwise inappropriate for a community platform.
Post misleading or false information, including fake reviews, fake stories, or impersonation of others.
Publish others’ personal information (addresses, phone numbers, private email addresses, government IDs, etc.) without their consent.
Spam or solicit, including:
Unsolicited commercial messages, mass marketing, chain letters, or repeated posting of the same content.
Upload harmful code, including viruses, malware, or anything intended to disrupt or damage the Services or users’ devices.
Interfere with the Services, including by:
Using bots, scrapers, or automated systems to access or “crawl” the Site
Attacking or overloading our servers or networks
Circumventing access controls or security measures.
Reverse engineer or modify any part of the Services except where such restriction is prohibited by law.
Sell, rent, or transfer your Account, or misrepresent your affiliation with any person or entity.
We may report activities we believe are unlawful to law enforcement or other authorities and cooperate with them as permitted by law.
8. Third Party Services
The Services may include links or integrations with third party websites, apps, and services (such as social networks, payment processors, or local partners).
You use third party services at your own risk. TucsonBuzz is not responsible for:
Their content, policies, or practices, or
Any damage or loss arising from your use of them.
If you believe a linked third party resource violates the law or this User Agreement, you may contact us and we will review it in our discretion.
9. Communications
By using the Services, you agree that we may contact you by:
Email,
In-site notifications, or
Other electronic means,
with notices relating to your Account, the Services, or legal documents (including updates to this User Agreement or our policies).
You may manage some communication preferences in your Account settings, but certain communications (such as legal notices) may be required.
10. Termination & Suspension
We may, at any time and without prior notice, suspend or terminate:
Your Account, and/or
Your access to some or all of the Services,
for any reason or no reason, including if we believe you have violated this User Agreement, the law, or community standards.
If your Account is terminated:
Your right to use the Services immediately ceases, and
Provisions that by their nature should survive termination (including licenses, disclaimers, indemnity, and limitations of liability) will remain in effect.
You may stop using the Services at any time and may request Account deletion as described above.
11. Warranty Disclaimer
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES AND ALL CONTENT ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT ANY WARRANTY OF ANY KIND, EXPRESS OR IMPLIED.
WITHOUT LIMITING THE FOREGOING, TUCSONBUZZ AND ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, AGENTS, AND PARTNERS (COLLECTIVELY, THE “TUCSONBUZZ ENTITIES”) DO NOT WARRANT THAT:
THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE;
ANY DEFECTS OR ERRORS WILL BE CORRECTED;
THE SERVICES OR ANY CONTENT WILL BE ACCURATE, RELIABLE, OR COMPLETE; OR
THE SERVICES OR SERVERS ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
ANY USE OF THE SERVICES IS AT YOUR SOLE RISK. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES, SO SOME OF THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU.
12. Indemnification
You agree to defend, indemnify, and hold harmless the TucsonBuzz Entities from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from:
Your use or misuse of the Services or Content;
Your User Content;
Your violation of this User Agreement; or
Your violation of any law or the rights of any third party.
We reserve the right to assume the exclusive defense and control of any matter subject to indemnification by you. You agree to cooperate with us in asserting any available defenses.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL THE TUCSONBUZZ ENTITIES BE LIABLE FOR:
ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR
ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES,
ARISING OUT OF OR RELATING TO YOUR USE OF (OR INABILITY TO USE) THE SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE TOTAL AGGREGATE LIABILITY OF THE TUCSONBUZZ ENTITIES FOR ANY AND ALL CLAIMS ARISING OUT OF OR RELATED TO THE SERVICES OR THIS USER AGREEMENT SHALL NOT EXCEED FIVE HUNDRED U.S. DOLLARS (US $500.00).
SOME JURISDICTIONS DO NOT ALLOW LIMITATIONS OF LIABILITY FOR CERTAIN DAMAGES, SO SOME OF THESE LIMITATIONS MAY NOT APPLY TO YOU.
14. Governing Law & Jurisdiction
This User Agreement and any dispute arising out of or relating to the Services shall be governed by the laws of the State of Arizona, without regard to its conflict of laws rules.
You agree that any legal action or proceeding arising out of or relating to this User Agreement or the Services will be brought exclusively in the state or federal courts located in Pima County, Arizona, and you consent to the personal jurisdiction and venue of such courts.
15. Modifications to the Services
We reserve the right to:
Modify, suspend, or discontinue any part of the Services at any time, with or without notice; and/or
Impose limits on certain features or restrict access to parts or all of the Services.
We are not liable to you or any third party for any modification, suspension, or discontinuation of the Services.
16. Miscellaneous
Entire Agreement. This User Agreement (including any Additional Terms and our Privacy Policy) is the entire agreement between you and TucsonBuzz regarding the Services and supersedes all prior agreements and understandings.
Severability. If any provision of this User Agreement is held invalid or unenforceable, that provision will be enforced to the maximum extent permissible, and the remaining provisions will remain in full force and effect.
No Waiver. Our failure to enforce any provision of this User Agreement will not be a waiver of that or any other provision.
Assignment. You may not assign or transfer this User Agreement or any rights or obligations hereunder without our prior written consent. We may freely assign or transfer our rights and obligations under this User Agreement.
Force Majeure. We are not liable for any delay or failure to perform due to causes beyond our reasonable control, including acts of God, natural disasters, war, terrorism, labor disputes, power failures, internet disruptions, or governmental actions.
Headings. Section headings are for convenience only and do not affect interpretation.
